These Terms of Service ("Terms") govern your access to and use of the AmarktAI Marketing platform and services. By accessing or using our services, you agree to be bound by these Terms.

You represent that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using our services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

AmarktAI Marketing provides an AI-powered marketing operating system that includes autonomous AI agents for content creation, SEO optimization, social media management, email marketing, analytics, and related marketing functions. Our services include:

  • AI agent deployment and management
  • Marketing content generation and optimization
  • Multi-channel campaign management
  • Analytics and reporting tools
  • Third-party platform integrations
  • API access (on applicable plans)

We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice.

3. User Accounts

To use our services, you must create an account and provide accurate, complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Promptly notifying us of any unauthorized use of your account
  • Ensuring your account information is accurate and up-to-date

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for unauthorized purposes.

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Violate any applicable laws, regulations, or third-party rights
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the integrity or performance of our services
  • Use our services to infringe upon intellectual property rights
  • Resell or redistribute our services without authorization
  • Use automated means to access our services except through our provided APIs
  • Generate content that is illegal, harmful, threatening, abusive, or otherwise objectionable

5. Intellectual Property

Our Intellectual Property

The AmarktAI Marketing platform, including its design, features, algorithms, and documentation, is owned by us and protected by intellectual property laws. You may not copy, modify, or reverse-engineer any part of our platform.

Your Content

You retain ownership of all content you provide to our platform and all content generated by our AI agents on your behalf. By using our services, you grant us a limited license to process your content solely to provide our services.

AI-Generated Content

Content created by our AI agents is provided to you under a perpetual, worldwide, royalty-free license. You are responsible for reviewing AI-generated content before publication and ensuring it complies with applicable laws and your brand guidelines.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMARKTAMARKETING AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You acknowledge that AI-generated content may contain errors or inaccuracies. You are responsible for reviewing and verifying all content before publication. We are not liable for any damages arising from the use of AI-generated content.

7. Termination

You may terminate your account at any time by contacting us or using the account settings in your dashboard. Upon termination:

  • Your access to our services will continue until the end of your current billing period
  • We will retain your data for 30 days after termination to allow for data export
  • After 30 days, your data will be permanently deleted from our systems
  • Sections of these Terms that by their nature should survive termination will remain in effect

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Cape Town, South Africa.
